Upways B.V., having its registered office and principal place of business at Spoorstraat 153, 6591 GT Gennep, registered with the Chamber of Commerce under number 77888286, also acting under the tradename Fairtix (“Fairtix”, “us”, “our”), is committed to protecting the privacy and security of your personal data. Fairtix has created this Privacy statement to inform you on how Fairtix collects and uses your personal data when you use our services, visit our website or get in touch with us. Fairtix is the controller, within the meaning of the General Data Protection Regulation (EU) 2016/679 (“GDPR”), of the processing of your personal data as indicated in this Privacy statement.
Fairtix provides an online system for the purchase, processing and settlement of tickets for admission to an event organised by or on behalf of third parties (“Ticket Provider Services”).

1. Which personal data does Fairtix process, for which purposes and on what legal ground?
Fairtix may process the following personal data of you as a customer and/or website visitor:
Contact details: your name, address, e-mail address and phone number.
Personal information: such as your gender, city and country of your residence and any personal data that you include in your purchase, account or feedback (i.e., request for medical assistance).
Special categories of personal data: such as your sexual orientation or health data.
Payment information: such as bank account number, payment details and bank account holder name.
Account data: such as your username and password, previously attended events, musical genre preferences and any other personal data that you include in your account.
Event and ticket details: such as event name, time of registration (early bird tickets, regular tickets or waiting list), time of sending the tickets and confirmation, time of entry on which the ticket is scanned at the event (scanning time).
Communication data: technical data of the equipment that is used to visit the website, such as IP address and software used.
Website data (depending on the settings for cookie preferences): surfing behaviour on our website, including mouse and clicking behaviour, duration and times of visits to the website. Fairtix processes your personal data for the following purposes and on the following legal grounds:
Provision of the Ticket Provider Services. The legal basis for the processing of your personal data for this purpose is the necessity to perform the agreement with you.
Getting in contact with you to provide you with relevant information regarding your ticket and/or event. The legal basis for the processing of your personal data for this purpose is the necessity to pursue our legitimate interest.
Sending newsletters, direct marketing through e-mail, sms, e.g. regarding upcoming events. The legal basis for the processing of your personal data for this purpose is your consent.
Profiling based on your interests so we can send you targeted marketing via either e-mail or sms. The legal basis for this processing of your personal data for this purpose is either your consent or our legitimate interest.
Website security and maintenance purposes. The legal basis for the processing of your personal data for this purpose is the necessity to pursue our legitimate interest.
Optimizing our marketing activities and to adjust our offer and our information on the website accordingly. The legal basis for the processing of your personal data for this purpose is the necessity to pursue our legitimate interest.
Analysing or tracking your website behaviour. When we track your website behaviour we will do this on the basis of your consent. When we analyse webiste visits (without privacy impact) we do this because it is necessary to pursue our legitimate interest.
In the context of the Ticket Provider Services, Fairtix may process personal data which could potentially reveal special categories of your personal data, such as health data and/or sexual orientation. For the processing of these special categories of personal data by Fairtix, you have to give your explicit consent. Please note that you are free to withdraw your consent at any time as explained further below in this Privacy statement (see under What rights can you exercise in relation to your personal data?).
2. Who has access to your personal data?
Fairtix may share your personal data with third parties in the following circumstances:
· Fairtix may share your personal data with event organizers for the purpose of our Ticket Provider Services. The event organizers are separate controllers within the meaning of the GDPR for the processing of your personal data. For more information on how the event organizers treat your personal data, we refer to their privacy statement.
- Fairtix may share your personal data with its processors, i.e. parties that provide products and services to Fairtix and thereby process personal data on behalf of Fairtix, such as IT service providers. In such cases, these other third parties may only use your personal data for the purposes described above and only in accordance with our instructions.
- Fairtix may share your personal data if required to do so by law or court order, for example with law enforcement agencies.
3. Does Fairtix transfer your personal data to third countries?
Your personal data is processed and stored within the European Economic Area (“EEA”).
It may be the case that we engage third parties who are located or have processing facilities outside the EEA. Note that te laws of such countries outside of the EEA may be less strict regarding your personal data than the laws in the EEA. In any case where we transfer personal data outside the EEA, Fairtix shall ensure that such a transfer is subject to appropriate safeguards. For instance, we may transfer your personal information to countries for which adequacy decisions have been issued or use contractual protections for the transfer of personal data.

4. How long will Fairtix keep your personal data?
Unless a specific retention period is mandated or permitted under applicable law, Fairtix will only retain your personal information for the duration of time necessary to fulfill the purposes described in this Privacy statement. For example, for taxation/company accounting purposes the minimum retention period is seven (7) years after the end of the fiscal year.
· Contact details/ personal information/ special categories of personal data: In case you contact us with a question, complaint or GDPR request, your communication data will be deleted ultimately six months after your question, complaint and/or GDPR request has been satisfactorily dealt with. If you are on our mailing list for the newsletter, we will delete your data as soon as you unsubscribe (by clicking the unsubscribe link), or ultimately one year after the last communication took place.
· Account data: We will retain your personal data for as long as your account is active or as needed to provide services to you, or as required to comply with legal obligations, resolve/settle disputes, or enforce the agreement between you and the organizer of an event. You can have your account deleted by sending an email to support@fairtix.io.

5. Which rights can you exercise in relation to your personal data?

Right of access
You are entitled to a copy of the personal data we hold about you and to learn details about how we use it.
Right to rectification
We take reasonable steps to ensure that the information we hold about you is accurate and complete. However, if you do not believe this is the case, you can ask us to update or amend it.
Right to erasure
In certain circumstances, you have the right to ask us to erase your personal information, for example where the personal data we collected is no longer necessary for the original purpose or where you withdraw your consent. However, this will need to be balanced against other factors. For example, we may not be able comply with your request due to certain legal or regulatory obligations.
